القيمة القانونية لعدالة التفاوض في العقود الدولية

Résumé: تهدف هذه الدراسة لمعالجة إشكالية مدى تكريس الأنظمة القانونية المقارنة لمقتضيات عدالة التفاوض في العقود الدولية. تزداد أهمية عدالة التفاوض بسبب تعدد المسائل الفنية والقانونية التي يتم التفاوض بشأنها، لكن يلاحظ تفاوت التشريعات المقارنة في تنظيم المقتضيات القانونية التي تكرس عدالة التفاوض على الرغم من المقاربات القضائية العديدة التي تَدْعم تدخل القاضي لترتيب المسؤولية المدنية. كلمات مفتاحية: أخلاقيات التفاوض.، حسن النية.، العقود التمهيدية. Abstract: This study aims to address the issue of fairness in the negotiation of international contractsin the light of the comparative legal systems.
