النظام القانوني للمصالحة الجمركية في التشريع الجمركي الجزائري

Résumé: الملخص المخالف للتشريع الجمركي ، قد يحال إلى أروقة العدالة بموجب دعوى عمومية أو جبائية لتوقيع الجزاءات المناسبة، وتتأسس إدارة الجمارك كطرف مدني في النزاع وقد تلجأ إدارة الجمارك إلى التسوية بطريق المصالحة الجمركية وفق الشروط اللازمة بعقد صلح في شكل قرار إداري تفرض فيه على المخالف المتصالح دفع مقابل مالي لصالح الخزينة العمومية وتفادي أروقة العدالة . ويلاحظ في قرار المصالحة الجمركية هيمنة الجهة الإدارية على إجراءات المتابعة ، وخرقها لمبادىء الإستقلالية انطلاقا من كونها حكما وخصما في المنازعة الجمركية على نحو يمكن القول فيه إنها عقوبة جزائية لا مجرد تقنية تفاوض ودية لإنهاء النزاع . Abstract The system of reconciliation in customs is considered one of the most important alternatives to a public lawsuit in light of contemporary criminal policy . As a result of the custums reconciliation process ,the custums administration gives up the poursuit of the customs crim in exchange for the person violating certain conditions . customs reconciliation and suspect systems such as criminal mediation. Customs reconciliation in Algerian law is one of the main reasons behind the expiry of the public and criminal proceedings , where the Algerian Customs Law has given special attention , its extremely important consequence , which has led us to consider them not only as reasons for the expiry the proceeding but as an alternative to judicial proceedings in which the customs administration party and judge that one is away from justice and voided and judicial oversight .
