التحقيق العقاري كآلية لتطهير الوضعية العقارية

Résumé: الملخص: سببت العوائق القانونية والتقنية التي واكبت نظام المسح العام للأراضي في ظهور القانون رقم 07/02 المتضمن تأسيس إجراءات لمعاينة الملكية العقارية وتسليم سندات الملكية عن طريق تحقيق عقاري كآلية لعملية التطهير العقاري، ويهدف هذا القانون إلى تأسيس إجراء لمعاينة حق الملكية العقارية وتسليم سندات الملكية، وقد بين المشرع الجزائري المجال الذي يسمح فيه بإجراء التحقيق العقاري، حيث تم تحديد المبررات التي تسمح بإجراء عملية التحقيق العقاري وذلك بالرجوع إلى القوانين التي تبين أنواع ملكية الأراضي، منها القانون المتعلق بالتوجيه العقاري والمعدل والمتمم. فيما حدد كذلك الشروط الواجب توفرها حتى يتمكن الطالب اللجوء لهذا الإجراء سواء كان افتقاده لسند ملكية أو حالة حيازته سند ملكية قديم. Abstract: The legal and technical obstacles that accompanied the general land system led to the emergence of Law No. 07/02, which establishes procedures for inspecting real estate ownership and delivering title deeds through a real estate investigation as a mechanism for the real estate purification process. This law aims to establish a procedure for inspecting real estate ownership rights and delivering title deeds. The Algerian legislator has specified the procedures that permit conducting a real estate investigation, specifying the justifications for conducting a real estate investigation by referring to the laws that define the types of land ownership, including the law on real estate guidance and its amendment . It also specified the conditions that must be met for an applicant to resort to this procedure, whether they lack a title deed or possess an old title deed.
