التحقيق العقاري كآلية مستحدثة لتطهير الملكية العقارية
Résumé: ملخص مذكرة الماستر: آلية التحقيق العقاري الهادفة إلى تطهير الملكية العقارية، نظمها المشرع الجزائري بموجب القانون 07/02المؤرخ في 27/02/2007 المتضمن تأسيس إجراء من أجل معاينة حق الملكية العقارية عن طريق التحقيق العقاري تبعه المرسوم التنفيذي رقم 08/147 المؤرخ في 19 ماي 2008، المتعلق بعمليات التحقيق العقاري وتسليم سندات الملكية، وهو إجراء إختياريوليس إلزامي، يختلف عن عقد الشهرة والآليات الأخرى التي عرفها التشريع العقاري سابقا والمشرع الجزائري دفعته عدة أسباب للجوء إلى آلية التحقيق العقاري، وللإستفادة من هذا الإجراء يجب توفر مجموعة من الشروط منها ماتعلق بالعقار محل المعاينة والتحقيق، ومنها مايتعلق بالحيازة القانونية المكسبة للملكية العقارية. ومن الناحية العملية فإن التحقيق العقاري يمر بعدة مراحل، مع إحترام التدابير القانونية والنصوص التنظيمية المنظمة لعملية التحقيق العقاري، وفي حالة نشوب أي نزاع في هذا الشأن يتم تسويته وديا من طرف المحقق العقاري أو عرضه على الجهات القضائية المختصة، وفي الأخير يتوج هذا الإجراء بتسليم سند الملكية من طرف مدير مسح الأراضي والحفظ العقاري المختص إقليميا . Abstract of the master thesis: The real estate investigation mechanism aimed at purifying real estate ownerships was regulated by the Algerian legislator under law 02-07 of 27/02/2007, whitsinludes the the establishment of a procedure for inspecting the right of real estate ownership through real estate investigation, followed by executive decree no:08-147 of 19/05/2008, related to real estate investigation operations and the delivery of title deeds which is an optional procedure, not mandatory, different from the goodwill contract and other mechanisms previously by real estate legislation, the Algerian legislator prompted several reasons to resort to the real estate investigation mechanism, and to benefit from this procedure , a set of conditions must be met, including those related to the real estate subject of the inspection, investigation, including those related to the legal gainful possession of real estate. From a pratical point of view, the real estate investigation goes throught several stage, while respecting the legal measures and regulatory texts regulating the real estate investigation process ownership by regionally competent land survey and cadastre director.
