تحريك الرقابة على دستورية القوانين في الدساتير المغاربية "الجزائر – تونس – المغرب"

Résumé: الملخص: الرقابة على دستورية القوانين هي أهم ركيزة لقيام دولة القانون، حيث انها الحصن المنيع لتكريس مبدا سمو الدستور من ناحية، وضمانة أساسية لحماية حقوق وحريات الافراد من ناحية أخرى، ولما كان موضوع دراستنا تحريك الرقابة الدستورية على القوانين في الدساتير المغاربية والذي يكتسي اهمية كبرى خاصة بعد النقلة النوعية التي والتحول الذي أحدثه المؤسس الدستوري في هذه الدول محل الدراسة والتي شملت مؤسسات القضاء الدستوري من حيث المؤسسة وتركيبتها وتحريكها وصلاحياتها. هذه النقلة النوعية في دساتير هذه الدول تمثلت في تحويل "المجلس الدستوري" الى "محكمة دستورية" وإعادة تنظيم هيكلتها وتضمينها ضمانات تساعد على استقلاليتها مما يساهم في فعاليتها، وكذلك تبني التعدد في آليات تحريك هذه المحاكم من خلال الرقابة الدستورية السياسية السابقة والرقابة الدستورية القضائية البعدية وهم "الإخطار الدستوري-الدفع بعدم الدستورية". هذا التحول النوعي للقضاء الدستوري المغاربي جاء بعد فشل الرقابة السياسية السابقة لوحدها في حماية الاحكام الدستورية، حيث أجمع الفقه الدستوري المقارن على أن الرقابة القضائية البعدية ناجحة قياسا لمدى فعاليتها في حماية الأحكام الدستورية، والتي اعتبرت احدى أهم الضمانات الدستورية التي كرسها المؤسس الدستورية لحماية حقوق الافراد وحرياتهم. Résumé :فرنسية أو انجليزية Summary: Monitoring the constitutionality of laws is the most important pillar of the establishment of the rule of law. It is a fundamental guarantee for the protection of the rights and freedoms of individuals. The subject of our study is the constitutional control of laws in Maghreb constitutions. This transformation of the constitutions of these States consisted in the transformation of the Constitutional Council into a Constitutional Court, the restructuring of its structure and the incorporation of safeguards that would help to ensure its independence, thus contributing to its effectiveness, as well as the adoption of a multiplicity of mechanisms for the mobilization of these courts through previous constitutional political oversight and post-constitutional judicial oversight, namely, "Constitutional notification - argument of unconstitutionality." This transformation of the Maghreb constitutional judiciary came after previous political oversight alone failed to protect constitutional provisions. Comparative constitutional jurisprudence unanimously agreed that post-judicial oversight was successful in relation to its effectiveness in protecting constitutional provisions, which were considered one of the most important constitutional guarantees enshrined by the Constitutional Founder.
