التسول بالأطفال بين التعاطف الاجتماعي والتجريم القانوني

Résumé: لعل من بين مظاهر الاختلالات المجتمعية الأكثر حساسية ومرارة هي ظاهرة التسول بالأطفال، والتي تفاقمت في مجتمعنا في الآونة الأخيرة بشكل خطير ووصلت إلى مستويات مقلقة خاصة بعد تعطيل الكثير من النشاطات الاقتصادية للكثير من الأسر بسبب إجراءات الحجر المنزلي التي خلفتها جائحة كورونا مؤخرا . ورغم الترسانة التشريعية التي تحمي الطفل من كل استغلال اقتصادي وتعريض حياته المادية أو المعنوية للخطر إلا أن هذه الجريمة تلق التعاطف الاجتماعي من شتى أطياف المجتمع وهو ما يدل على وجود خلل اجتماعي /قانوني في التعاطي مع هذه الظاهرة ذات الأبعاد الخطيرة. Perhaps among the manifestations of the most sensitive and bitter societal imbalances is the phenomenon of child beggary, which has recently seriously exacerbated in our society and reached alarming levels, especially after the disruption of many activities due to the home quarantine procedures left by the Corona pandemic recently. Despite the legislative arsenal that protects the child from all economic exploitation and endangering his material or moral life, this crime receives social sympathy from all segments of society, which indicates the existence of a social / legal imbalance in dealing with this phenomenon of dangerous dimensions.
