دور هيئات الرقابة الخارجية في ضمان شفافية اجراءات ابرام الصفقات العمومية دراسة في اطار المرسوم الرئاسي الجديد 15-247 المتضمن تنظيم الصفقات العمومية وتفويضات المرفق العام

Résumé: يعد دور لجان الصفقات في مراقبة اجراءات ابرام الصفقات العمومية، أكثر فاعلية و قوة مقارنة مع ما كان عليه الوضع بالسابق، كما أصبحت تقوم بدور هام يتجلى في تقويم اجراءات إبرام الصفقات، و الفصل في الطعون و النزاعات بين أطرافها، وتختلف هاته اللجان حسب المعيار المالي والعضوي الى لجان متواجدة على المستوى الوطني واخرى على المستوى المحلي، والهدف الاساسي من اشاء اللجان هو ضمان شفافية ابرام الصفقات العمومية. من خلال هاته الورقة البحثية سنحاول الاجابة على الاشكالية التالية الى أي مدى تساهم هيئات الرقابة الخارجية القبلية للصفقات العمومية في مراقبة تطبيق احكام تنظيم الصفقات العمومية وتفويضات المرفق العام؟ وللإجابة على هذه الإشكالية سنقوم باستعراض تشكيلة اللجان الخاص بالرقابة الخارجية القبلية للصفقات العمومية (مبحث أول) ثم الدور المنوط بها من خلال التأكد من تطبيق احكام التنظيم وفصلها في الطعون (مبحث ثاني) It is the role of the Monitoring Committees of the transactions in the procedures for the conclusion of public deals, more effective, and compared with the situation in the past, it has become an important role is reflected in the evaluation procedures for concluding transactions, and the chapter on appeals and disputes between the parties.These differ according to the fiscal criterion and organic committees committees to present at the national level and at the local level, the fundamental objective of the committees is to ensure transparency, I want the conclusion of public deals. Hrough this paper, we will try to answer the following question: To what extent do the external audit bodies of tribal public transactions contribute to the monitoring of the application of the provisions of the regulation of public transactions and the mandates of the General Facility? In order to answer this problem, we will review the composition of the committees on external tribal control of public transactions (first section) and then the role entrusted to them by ensuring the application of the provisions of the organization and its separation in appeals (second section).
