آليات حماية حقوق أسرى الحرب أثناء النزاعات المسلحة - بين النصين الإسلامي والدولي-

Résumé: لا يختلف اثنان في أن الشريعة الإسلامية السمحاء كان لها فضل السبق في المعاملة الإنسانية لأسرى الحرب، بغض النظر على انتمائهم أو عقيدتهم، فأطعموا الأسير وقدموا له الطعام، واختاروا له مكان الحجز، ووفروا له اللباس... وعلى الرغم من أـن المجتمع الدولي حاول إيجاد حلول للأسرى ضمن منظومة اتفاقيات جنيف الأربعة و ما تلاها من بروتوكولات التي تحث على معاملة الأسرى معاملة تليق بكرامة الإنسان، حيث حثت الدول على توفير الحقوق الأساسية للأسير من مأوى وملبس وغذاء و عدم التعذيب والاستنطاق والحط من كرامته، وعدم الالتفات إلى دينه أو انتمائه السياسي أو الجهوي أو بسبب الجنس أو اللغة..... ومع ذلك ما يزال التعامل مع الأسرى بمكيالين، معتمدين على كثير من الحسابات السياسية و الجهوية والعنصرية. Although the international community has tried to find solutions to the prisoners within the system of the four Geneva Conventions and the protocols that have followed that urge the treatment of prisoners in a treatment befitting human dignity, as it urged states to provide the prisoners with basic rights of shelter, clothing, food, freedom from torture and interrogation And demeaning his dignity, and not paying attention to his religion, political or regional affiliation, or because of gender or language... Nevertheless, dealing with the prisoners is still double standard, dependent on many political, regional and racial calculations.
