Résumé: تعتبر اتفاقية جنيف الأولى لعام 1864 بداية لولادة القانون الدولي الإنساني الذي يتشكل من نصوص مكتوبة وعرفية، ثم من بعد اتفاقيات جنيف لعام 1949 ليكتمل بالبروتوكولين الإضافية لعام 1977. ورغم أن هذه الاتفاقيات لم تعرف أسرى الحرب، إلا أن اتفاقية جنيف الثالثة لعام 1949 قامت بتحديد هذه الفئات المشمولة بالحماية الدولي في النزاعات المسلحة الدولية، وتم استعمالها بالبروتوكول الإضافي الأول لعام 1949، حيث عرضت التوقيع والتصديق والانضمام من قبل المؤتمر الديبلوماسي بوضع اتفاقيات دولية لحماية ضحايا الحروب في جنيف خلال الفترة الممتدة من 21 أفريل إلى 12 أوت 1949، ودخلت حيز النفاذ في 21 أكتوبر 1950، تضمنت حقوق وحماية فئة أسرى النزاعات المسلحة. غير أن ما يعاب على المجتمع الدولي عدم قدرته على وضع آليات دولية حقيقة لتطبيق بنود هذه الاتفاقيات الدولية، مما أدى إلى نجاة كثير من المجرمين الدوليين من العقاب على جرائمهم في حق هذه الفئات. Abstract : The First Geneva Convention of 1864 is the beginning of the birth of international humanitarian law, which consists of written and customary texts, and then after the Geneva Conventions of 1949 to be completed by the two Additional Protocols of 1977. Although these agreements did not define prisoners of war, the Third Geneva Convention of 1949 determined these The groups covered by international protection in international armed conflicts, and they were used by the first additional protocol of 1949, where they offered signature, ratification and accession by the diplomatic conference to the development of international agreements to protect victims of wars in Geneva during the period from April 21 to August 12 1949, and entered into force on 21 October 1950 included the rights and protection of prisoners of armed conflict category.
