Résumé: يرتبط موضوع البناء في المناطق المحمية والأقاليم الثقافية والأثرية البارزة ارتباطا وثيقا بالقانون رقم 03-10 المتعلق بحماية البيئية في إطار التنمية المستدامة، على اعتبار أن هذه المناطق تتميز بتنوع بيولوجي ومميزات طبيعية وهو ما جعل المشرع يوليها حماية خاصة. ولذلك فإن الجزائر وبعد حصولها على الاستقلال اتجهت إلى الانضمام إلى الاتفاقيات الخاصة بحماية التراث العالمي الثقافي والطبيعي المبرمة بباريس في 23 نوفمبر 1973 وكذا الاتفاقية المتعلقة بالمناطق الرطبة ذات الأهمية الدولية باعتبارها ملاجئ للطيور البرية والبروتوكول المتعلق بالمناطق المتمتعة بحماية خاصة بالبحر الأبيض المتوسط لسنة 1985، هذه المناطق لها نظام قانوني خاص المراد منه تقرير حماية خاصة باعتبارها مناطق محمية.
