أحكام المسؤولية الجزائية للمرقي العقاري في القانون الجزائري

Résumé: إن المسؤولية الجزائية للمرقي العقاري من الأمور المستحدثة والتي أكد عليها القانون رقم 11-04 المحدد للقواعد التي تنظم نشاط الترقية العقارية وذلك من أجل معالجة الثغرات الموجودة في القوانين السابقة التي عالجت هذا الموضوع نظرا لأن المسؤولية الجزائية لها أهمية كبيرة في ضبط مجال الترقية العقارية من تعسف المرقين العقاريين على المقتني، لذا فرض المشرع مجموعة إلتزامات وشروط على المرقي العقاري قبل وأثناء ممارسة مهنته وحتى بعد تنفيذ عقود الترقية العقارية، إذا ما تمت مخالفة هذه الشروط والإلتزامات يكون المرقي العقاري مسؤولا جزائيا ويتعرض لعقوبة الحبس أو الغرامة ومن خلال هذه الورقة البحثية سنتطرق إلى كيفية تنظيم هذه المسؤولية وكذا العقوبات المطبقة في هذا المجال. The criminal responsibility of the real estate promoter is one of the new things that was confirmed by law No 11-04 that sets out the rules regulating the real estate promotion activity, in order to address the gaps in the previous laws that dealt with this issue, given that the criminal responsibility has a great importance in controlling the field of real estate promotion from the arbitrariness of real estate promoters to the collector, so the legislator imposed a set of obligations and conditions on the real estate promoter before and during the exercise of his profession, and even after the implementation of the real estate promotion contracts, if these conditions and obligations are violated, the real estate promoter is criminally responsible and subject to the penality or fine, and through this research paper, we will discuss how to organize this responsibility and as well as the sanctions applied in this area
