الاهلية القانونية للطفل للالتحاق بالعمل في التشريع الجزائري

Résumé: أكثر من 250 مليون طفل اليوم يعملون عبر العالم، منهم 150 مليون في ظروف خطرة بالمقابل كل سنة أكثر من 1 مليون من هؤلاء الأطفال يمثلون ضحايا سوء المعاملة ،عمالة الأطفال قبل السن القانوني الأدنى، المحدد في التشريعات والاتفاقيات أصبح معضلة وإشكالية واجهتها التشريعات والاتفاقيات بتحديد سن أدني لعمل الأطفال، دراستنا تهدف الى تحديد الاهلية القانونية للاستغلال الاقتصادي للأطفال في التشريع الجزائري ، و الى اي مدى كانت الجزاءات القانونية المقررة عند مخالفة سن التشغيل رادعة لمنع الاستغلال الاقتصادي لهم و خلصنا الى ان القضاء على أسوأ أشكال عمل الأطفال، هي مسؤولية جماعية لا تخص جهة واحدة بعينها ، و النصوص و الجزاءات غير كافية لوحدها ، بل تشارك الجهات الرسمية ، وغير الرسمية،لمحاربتها ضروري و ملح لحماية شريحة الطفولة ، شباب الغد وبناة المستقبل. More than 250 million children today work around the world, 150 million of them in hazardous conditions. Each year, more than 1 million of these children are victims of ill-treatment. Our study aims at determining the legal capacity for the economic exploitation of children in Algerian legislation, and to what extent the legal penalties prescribed for violating the age of employment were a deterrent to prevent economic exploitation of them and concluded that the elimination of the worst forms of child labor, It is a collective responsibility that does not belong to one particular entity, and the texts and sanctions are not enough on their own, but the participation of official and non-official bodies, to combat it is necessary and urgent to protect the childhood segment, the youth of tomorrow and the builders of the future.
