Résumé: تتمحور هذه الدراسة حول الأحكام الخاصة لقيام نظام المسؤولية الدولية عن أضرار النفايات الخطرة والتخلص منها عبر الحدود، بوصفها نفايات ذات طابع خاص، تعامل معها المجتمع الدولي وحاول تنظيمها في إطار قانوني دولي خاص. يعتبر بروتوكول اتفاقية بازل لسنة 1999، البروتوكول الدولي الذي تناول نظام المسؤولية والتعويض عن الضرر الناجم عن نقل النفايات الخطرة والتخلص منها عبر الحدود مبرزا بذلك أسس قيام المسؤولية الدولية بمفهوميها الكلاسيكي والحديث. *** Abstract : This study revolves around the special provisions for creating a system of international liability for damage caused by hazardous wastes and their transboundary disposal, as wastes of a particular nature, which the international community has dealt with and tried to regulate within a framework special international legal. The Protocol to the Basel Convention of 1999 is the international protocol that deals with the system of liability and indimnity for damage resulting from the movement of hazardous wastes and their disposal across borders, highlighting the foundations of international responsibility in its classical and modern terms
