المسؤولية الجنائية المترتبة عن حواد ث المرور في الشريعة الاسلامية و القانون الجزائري ـــــ دراسة مقارنة

Résumé: جاء ھذا الموضوع لدراسة "المسؤولیة الجنائیة المترتبة عن حوادث المرور بین الشریعة الإسلامیة والقانون الجزائري"، التي تعتبر نازلة من نوازل ھذا العصر تحتاج إلى دراسة فقھیة وقانونیة متقنة ودقیقة، لذلك احتوى البحث على مبحث تمھیدي یتضح فیھ مفھوم المسؤولیة الجنائیة وأساسھا وتطورھا التاریخي في الشریعة الإسلامیة والقانون الجزائري، ثم بیان المسؤولیة الجنائیة وذلك من خلال توضیح أركانھا وشخصیتھا وسببھا وشرطھا وموانعھا في الشریعة الإسلامیة والقانون الجزائري. ثم الوقوف على حقیقة حوادث المرور وحكمھا وأسباب وقوعھا وأنواعھا ومختلف النتائج التي تخلفھا. وذلك في الجزء الأول من ھذا البحث. في حین یتطرق الجزء الثاني إلى العقوبات والجزاء المقررة على جرائم حوادث المرور في الشریعة الإسلامیة والقانون الجزائري.This was the subject for the study of "criminal liability arising from traffic accidents between Islamic and Algerian law", which is coming down from the cataclysms of this age need to study jurisprudence and legal neat and precise, so it contains a search on the Study of preliminary unclear where the concept of criminal responsibility and the basis of its historical development in Islamic law The Algerian law, then a statement of criminal responsibility by clarifying its foundations, and caused her personality and her condition and intubation in Islamic law and Algerian.
