أثر جائحة كورونا على تنفيذ العقد " دراسة حالة عقود الأعمال والعقد التجاري الدولي " أنموذجا

Résumé: بتاريخ 11 مارس 2020 صنفت منظمة الصحة العالمية الجائحة « épidemie » بـ : جائحة وبائية عالمية ذات طبيعة شاملة انعكست تداعياتها الخطيرة وآثارها المدمرة على الاقتصاد العالمي، مما استوجب على الحكومات والدول اتخاذ الإجراءات الإدارية والتدابير الاستثنائية التي تعرف في فقه القانون الإداري بـ "إجراءات الضبط الإداري أهمها إجراءات الحجر الصحي لمجابهة جائحة كورونا (كوفيد-19)، ولكن هذه الجائحة أثرت على الاقتصاد والمؤسسات والعقود. ومن المسائل التي طرحت في قانون العقود إثر تفشي جائحة كورونا هي شرطي القوة القاهرة والظروف الطارئة وأثرها على تنفيذ العقد. بشأن نظريتي القوة القاهرة والظروف الطارئة فالأولى تؤدي إلى اضطراب دائم للاقتصاد العقدي بينما الثانية تتمثل في تعديل اقتصادية العقد « réajuster l’économie du contrat » لكونه يجعل تنفيذ العقد أكثر صعوبة وإرهاقا للمدين. On March 11, 2020, the World Health Organization classified the pandemic “épidemie” as: a global epidemic pandemic of a comprehensive nature whose dangerous repercussions and devastating effects on the global economy were reflected, which required governments and countries to take administrative measures and exceptional measures known in the jurisprudence of administrative law as “administrative control procedures. The most important of them are quarantine measures to confront the Corona pandemic (Covid-19). But this pandemic has affected the economy, institutions and contracts. Among the issues raised in the contract law following the outbreak of the Corona pandemic are the force majeure and emergency conditions and its impact on contract implementation. The first leads to permanent disruption of the contractual economy, while the second is represented in the adjustment of the economy of the contract (réajuster l'économie du contrat), because it makes the implementation of the contract more difficult and burdensome for the debtor.
