اشتراك القاصر في الجماعات الإرهابية دراسة مقارنة بين الشريعة والقانون الجزائري

Résumé: الملخص : يتناول هذا البحث دراسة أحكام القاصر فيما يتعلق باشتراكه في المجموعات الإرهابية، حيث لا يخفى على أحد ما جنته هذه الأخيرة على الأمة الإسلامية عموما والجزائر خصوصا، ومع التطور في أساليب القتال والتجنيد والتكنولوجيا، فإن من أخطر الأساليب التي صارت تعتمدها الجماعات في قتالها هي تجنيد القصر إما للقتال والمشاريع الانتحارية، وإما للتحرك ونقل المعلومات بين الشبكات الإرهابية. ويسعى هذا البحث للمقارنة بين تعاطي الشريعة الإسلامية مع هذه الشريحة الجانحة من المجتمع وبين تعاطي القانون الوضعي، وبيان مواطن الاتفاق والاختلاف بينهما. Abstract This research deals with the study of the minor's judgments regarding his participation in terrorist groups. The latter is known to the Islamic Ummah in general and Algeria in particular. As the methods of fighting, recruitment and technology develop, one of the most dangerous methods adopted by the groups in fighting them is the recruitment of minors Either for fighting and suicide bombings, or for moving and transferring information between terrorist networks. This research seeks to compare the use of Islamic law with this segment of the delinquent society and the use of positive law, and to indicate the areas of agreement and differences between them.
