Résumé: للبصمة الوراثية أهميتها في مجال الاثبات الجزائي، فباعتمادها يكون المشرع الجزائري اعتمد نظام الاثبات العلمي في المجال الجزائي، وهذا لما لها من مصداقية من دقة النتيجة وسهولة الوصول للعينة محل التحليل، لكن هذه الأهمية محكومة بشرط مشروعية تحليل البصمة الوراثية، واعتماد طرق علمية محكمة لتحليلها في مخابر معتمدة، وبتوافر هذه الشروط تحتل البصمة الوراثية الصدارة بين باقي الأدلة الجزائية الكلاسيكية التي تتميز بالظنية، ما يجعل البصمة الوراثية تملك قوة اثباتية قد تفرض نفسها على قناعة القاضي، لكن هنا يجب التمييز فالبصمة لها قوة الاثبات القطعية بالنسبة لإسنادها لصاحبها، والنسبية بالنسبة لإسناد الفعل المجرم لصاحب هذه البصمة، وهنا القاضي يحكم وفق قناعته بالموازنة بين مختلف الأدلة بالتساوي دون ترتيب ولا تمييز.
