متطلبات حوكمة الرقابة الشرعية في المؤسسات المالية الإسلامية

Résumé: تهدف هذه الدراسة لتوضيح متطلبات حوكمة الرقابة الشرعة في المؤسسات المالية الإسلامية، حيث يعد نظام الحوكمة في المؤسسات المالية الإسلامية ضرورة حتمية للحفاظ على كفاءتها واستقرارها. في ظل التغييرات المستمرة التي تشهدها الصناعة المالية الاسلامية، ولقد توصلنا من خلال هذه الدراسة لكون الحوكمة بمبادئها ومعاييرها وما تفترضه من شفافية ونزاهة تعتبر ركيزة أساسية لدعم نشاط المؤسسات المالية الإسلامية، حيث تمثل نظاماً رقابياً فعالاً لإحكام السيطرة على أداء هذه المؤسسات، لذا فإن الجهد الأكبر ينبغي أن يوجه إلى تطويرها وتفعيلها وحوكمتها. This study aims to clarify the requirements of Shariah control governance in Islamic financial institutions, as the system of governance in Islamic financial institutions is an imperative to maintain their efficiency and stability. In light of the continuous changes taking place in the Islamic financial industry, and we have concluded through this study that governance, with its principles and standards, and its assumptions of transparency and integrity, is a basic pillar to support the activity of Islamic financial institutions, as it represents an effective tool for controlling the company and is considered an effective control system to tighten control over the performance of these institutions. Therefore, the greatest effort should be directed to develop, activate and govern it.
