التنظيم القانوني للشروط الموضوعية لصحة عملية الترشح للانتخابات النيابية في الأنظمة الانتخابية المغاربية ( الجزائر - تونس – المغرب ).

Résumé: الملخص: تهدف هذه الدراسة إلى تسليط الضوء على الشروط الموضوعية الواجب توافرها للترشح لعضوية المجالس التشريعية، في الأنظمة الانتخابية المغاربية الجزائر، تونس والمغرب وهذا من خلال دراسة مقارنة لما جاء في القوانين الانتخابية لهذه الدول، للوصول الى اوجه الاتفاق و الاختلاف بينها، بدءا بالتأصيل القانوني لحق الترشح في هذه القوانين الانتخابية ، و من ثم دراسة الشروط الايجابية والسلبية لممارسة هذا الحق، والتي اوصلتنا الى خلاصة مفادها أن كلا من هذه القوانين الانتخابية تقاربت إلى حد كبير في شروط وموانع الترشح، وإن كان هناك بعض التفاوت بينها،كما قدمنا توصيات في خاتمة الدراسة نهيب بالمشرع الانتخابي لدول الدراسة بمراعاتها Abstract: This study aims to shed light on the objective conditions that must be met for candidacy for membership of legislative councils, in the Maghreb electoral systems of Algeria, Tunisia and Morocco, and this is through a comparative study of what was stated in the electoral laws of these countries, to reach the points of agreement and differences between them, starting with the legal establishment of the right to run In these electoral laws, and then studying the positive and negative conditions for the exercise of this right, which brought us to the conclusion that each of these electoral laws converged to a large extent in terms and impediments to candidacy, although there is some disparity between them. The electoral legislator of the study countries shall take into account them.
