حق التصرف في براءة الاختراع في التشريع الجزائري

Résumé: نستخلص بعد إنتهائنا من دراسة التصرفات القانونية الواردة على براءة الإختراع في التشريع الجزائري المتمثلة في التنازل و الرهن بالإضافة إلى الترخيص بالإستغلال ، المنصوص عليهم في ظل الأمر 03-07 المتعلق ببراءة الإختراع ، بأن التنازل عن البراءة إما أن يكون بمقابل أو بدون مقابل ، و قد يكون كليا أو جزئيا ، و في حالتين لا بد من إتباع إجراءات التسجيل ، أما الرهن يكون لضمان دين معين تطبق أحكام القانون المدني فيه إذا كان الدين مدني و أحكام القانون التجاري إذا كان الدين تجاري ، كما يمكن أيضا التصرف في براءة الإختراع عن طريق عقد الترخيص بالإستغلال الذي يعتبر من أكثر العقود إستعمالا في نطاق الإختراعات لأنه يتيح للمخترع فرصة إستغلاله من جهة و الإحتفاظ بحقه في الملكية من جهة أخرى ، و يكون إما إختياريا أو إجباريا ، و في الأخير نشير إلى الوثيقة التي تمنح للمخترع ليست بأبدية و بالتالي فهي تنقضي بمرور المدة المحددة لها في القانون أو بتخلي المخترع عن البراءة أو صدور حكم نهائي ببطلان البراءة أو بسقوطها أو إذا لم يقم المخترع بدفع الرسوم اللازمة . Abstract We conclude after we have studied the legal actions contained in the patent in the Algerian legislation represented in assignment and mortgage in addition to the license for exploitation, stipulated under Ordinance 03-07 relating to the patent, that the assignment of the patent shall be either with or without consideration, And it may be wholly or partially, and in two cases it is necessary to follow the registration procedures. As for the mortgage, it is to guarantee a specific debt, in which the provisions of the Civil Code are applied if the debt is civil and the provisions of the Commercial Code if the debt is commercial. It is also possible to dispose of the patent through the exploitation license contract, which is one of the most widely used contracts in the scope of inventions because it allows the inventor the opportunity to exploit it on the one hand and retain his right of ownership on the other hand. And it is either optional or compulsory, and in the last we refer to the document granted to the inventor is not eternal and therefore it expires by the passage of the period specified for it in the law or by the inventor’s abandonment of the patent or the issuance of a final judgment invalidating the patent or its forfeiture or if the inventor did not pay the necessary fees.
