الوصول غير التمييزي الى فوائد العلم بعد جائحة كوفيد 19

Résumé: الملخص: تهدف الدراسة الى الكشف عن الاهمية الجديدة التي منحتها جائحة كوفيد 19 للحق في الوصول غير التمييزي الى فوائد العلم، المنصوص عليه في المادة 27 من الإعلان العالمي لحقوق الإنسان والمادة 15 (1) (ب) من العهد الدولي الخاص بالحقوق الاقتصادية والاجتماعية والثقافية، والذي يقع على الدول بموجبه التزام بتأمين التعاون الدولي بهدف وصول الجميع الى اللقاح. وقد خلصت الدراسة الى أن جائحة كورونا قد كشفت عن الاختلالات البنيوية في إعمال هذا الحق وممارسته، الناجمة عن التفاوتات الاجتماعية، وعمق فجوة التقدم العلمي والتكنولوجي بين الدول. لذلك فإن التعافي من كوفيد 19 يستلزم الاسترشاد بحقوق الإنسان، وخاصة الحق في الوصول غير التمييزي الى فوائد العلم، والحق الجماعي في الصحة، وبالمبادئ الانسانية المطبقة في حالات الجوائح المنبثقة عن الالتزامات الدولية لحقوق الإنسان. الكلمات المفتاحية: جائحة، الوصول ، فوائد العلم، حقوق الإنسان. Abstract: The study aims to reveal the new importance given by the Covid-19 pandemic to the right to non-discriminatory access to the benefits of science as included in article 27 of the Universal Declaration of Human Rights and article 15(1)(b) of the International Covenant on Economic, Social and Cultural Rights according to which states have an obligation to secure international cooperation for the access to the vaccine, and it results that Corona pandemic has revealed structural imbalances in the realization and practice of this right caused by social inequalities, and the depth of the scientific and technological progress gap between countries. Therefore recovery from Covid 19 requires Guidance on human rights and the humanitarian principles applied in pandemics. Key words: pandemic, access, benefits of science, human rights.
