الهيئة الوطنية للوقاية من الفساد ومكافحته بين الفاعلية والجمود

Résumé: الملخص: تعتبر جرائم الصفقات العمومية شكلا من أشكال الفساد الاداري الذي يصعب إكتشافه لأنها تتم بسرية، وتعتبر مجالا خصبا للفساد لأنها أكبر وسيلة لإستغلال الأموال العامة وأكبر مسار تتحرك فيه، مما جعل الجزائر من الدول السباقة لسن قانون الوقاية ومكافحة هذه الجرائم، بحيث إعتمد المشرع عدة آليات مختلفة لتحقيق االهدف المقصود من ورائها كما يتضح من مختلف القوانين التي اتخذتها الجزائر والتعديلات التي أجرتها، وذلك لضمان مكافحة فعالة لجرائم الصفقات العمومية، ومنذ إصدار تعديل قانون الوقاية من الفساد و مكافحته سنة 2015 شهدت الجزائر نشاطا جديا في إطار مكافحة جرائم الصفقات العمومية يتمثل بشكل رئيسي في إنشاء هيئات إشرافية متخصصة جديدة، مثل الهيئة الوطنية للوقاية من الفساد ومكافحته الذي تم بموجبه إحداث أداة عملية للبحث ومعاينة جرائم الفساد والديوان الوطني لقمع الفساد وكذا اساليب التحقيق و التحري الخاصة كما أقر من جهة أخرى عقوبات أصلية وتكميلية تخص مرتكبي جرائم الصفقات العمومية سواء كانوا أشخاصا طبيعيين أو معنويين. Abstract: Public procurement crimes are considered a form of administrative corruption that is difficult to detect because they are conducted in secrecy, and are considered a fertile field for corruption because they are the largest means of exploiting public funds and the largest path in which they move, which made Algeria one of the first countries to enact a law to prevent and combat these crimes, so that the legislator adopted several different mechanisms To achieve the intended goal behind it, as evidenced by the various laws adopted by Algeria and the amendments it has made, in order to ensure an effective fight against public procurement crimes. The establishment of new specialized supervisory bodies, such as the National Authority for the Prevention and Combating of Corruption, according to which a practical tool was created to search and examine corruption crimes, the National Bureau for the Suppression of Corruption, as well as special methods of investigation and investigation. or spiritual.
