رهانات النقابات المستقلة في نزاعات العمل الجماعية للمؤسسة الجزائرية -مقاربة سوسيولوجية للفعل النقابي- The Challenges Of Autonomous Unions In Collective Labor Disputes Of Algerian Institutions

Résumé: تحرر الفعل النقابي داخل المنظمات الجزائرية من الأحادية النقابية لنقابة الإتحاد العامل للعمال الجزائريين التاريخية . UGTA انطلاقا من دستور 1989 الذي مثل منعطفا حاسما في ممارسة الحقوق والحريات العامة في الجزائر. فبرزت نقابات العمل المستقلة ، مما طرح اشكالية التغيير التنظيمي العقلاني للقواعد التشريعية للتوظيف في نزاعات العمل الجماعية للمؤسسات الجزائرية. تهدف هذا الدراسة الميدانية إلى تسليط الضوء وفق مقاربة نظرية سوسيولوجية على ظهور حراك نقابي استثنائي مستقل في قطاع التربية الوطنية، خرج عن أسس النضال النقابي المقنن المعتاد في نزاعات العمل الجماعية، والمتمثل في نقابة CNAPESTE المستقلة بعقلانيتها المحدودة، التي اعتمدت على مصادر السلطة التي تمتلكها كفاعل استراتيجي من خلال الإضرابات المفتوحة، لفرض منطق التغيير التنظيمي للمسار المهني للأساتذة في أطوار التدريس الثلاثة، بصدور المرسوم التنفيذي رقم 12–240، الذي يعدل ويتمم المرسوم التنفيذي رقم 08-315 المتضمن القانون الأساسي الخاص بالموظفين المنتمين للأسلاك الخاصة بالتربية الوطنية، بعد سنوات من النزاعات الجماعية. على الرغم من رد الفعل الاستراتيجي للتنظيم الرّسمي الممثل في وزارة التربية الوطنية، الذي قاوم هذا التغيير التنظيمي للتوظيف. فحدث تغيير نوعي في النضال النقابي. من مجرد هيكل تنظيمي بسيط إلى شريك اجتماعي فاعل. Trade union action within Algerian organizations has emancipated itself from the historic unilateralism of the Union of Algerian Workers UGTA. on the basis of the 1989 Constitution, which represented a decisive turning point in the exercise of public rights and freedoms in Algeria. Autonomous unions have emerged, which has raised the problem of rational organizational change in legislative employment rules in Algerian companies. This field research aims to shed light, according to a sociological theoretical approach, on the emergence of an exceptional and independent trade union movement in the national education sector, which has deviated from the foundations of the standardized trade union struggle usual in conflicts. collectives of labor, represented by the autonomous CNAPESTE union with its limited rationality, which relied on the sources of power that it possesses as a Strategic actor through ilimited strikes, to impose the logic of organizational change in the course professional teachers, with the promulgation of Executive Decree No. 12-240, which modifies and supplements Executive Decree No. 08-315 containing the fundamental law of employees belonging to the national education sector. There has been a qualitative change in the union struggle. From a simple organizational structure to an active social partner.
