الأساس القانوني للإلتزام بموجب خطاب الإعتماد المستندي

Résumé: قيام عملية الاعتماد المستندي على عدة ترتيبات تعاقدية (عقد بيع دولي - عقد فتح الاعتماد المستندي وخطاب الإعتماد) جعل منها أكثر العمليات تعقيدًا من الناحية القانونية ، لذلك فإن تحديد الضوابط القانونية التي تجمع بين المتعاقدين هي الأساس الذي يرتكز عليه لمعرفة طبيعة التصرف القانوني ، ويستتبع ذلك تحديد الالتزامات المترتبة عنه. وإذا كان عقد البيع وعقد الاعتماد المستندي مجرد عقود خاضعة للنظرية العامة للعقد في القانون المدني في جميع جوانبها ،فإنه على الخلاف من ذلك العلاقة القانونية بين البنك فاتح الاعتماد والمستفيد البائع وجدت تفسيراً لها في إطار التصرف القانوني الانفرادي بموجب خطاب الاعتماد وحسن التنفيذ. Summary : Regarding its several contractual regulations(international selling contract, documentary credit opening contact and letter of credit), the documentary credit's operation has become one of the most complex operations in its juridical form ; as a consequence, the determination of the juridical terms linking the contractors is the basis which must be taken into account to know the nature of juridical action and also the determination of its relative engagements. If the contract of sale and the contract of documentary credit are just considered as submitting contracts to the general theory of the contract in the Civil Code in its whole parts ; On the contrary, the juridical relation between the opening bank and the beneficiary seller has found its explanation in the juridical individual action using the letter of documentary credit
