الإعتماد المستندي وأثر مبدأ إستقلالية إلتزام البنك فيه

Résumé: يعتبر عقد الاعتماد المستندي من أهم عمليات الإئتمان التجاري التي تؤثر وتحافظ على العلاقات التجارية وتسهل حركة التجارة الدولية، فهو يعتبر أحد وسائل الدفع الهامة والمتطورة التي ابتدعها الفكر القانوني المصرفي ، والتي يمكن من خلالها تسوية الالتزامات الناشئة عن الصفقات التجارية الدولية، فهو يضمن لأطراف الصفقة في العقد الدولي تنفيذ الطرف الآخر لالتزاماته التعاقدية نتيجة تدخل البنوك لتسوية هذه الالتزامات. The letter of credit contract is one of the most important commercial credit operations that affect and maintain trade relations and facilitates the movement of international trade. IT is one of the important and advanced means of payment that created by the banking legal thought and through which the obligations arising from international business transactions can be settled. It guarantees to the parties to the international sales contract that the other party will fulfill its contractual obligations as a result of banks intervening to settle these obligations.
