قضايا المياه الفقهية في المغرب والأندلس من خلال النوازل الفقهية نوازل الأحكام للبرزلي نموذجا

Résumé: يعتبر الفقه النوازلي المالكي مصدرا ثريا للفتوى والاجتهاد، كونه يرصد تطورات الأحداث والقضايا في المجتمع، ومن المواضيع التي نالت قسطا كبيرا من كتب النوازل مسألة المياه، فقد كانت النوازل المائية حاضرة في كتب النوازل ، وهو ما نلمسه في فتاوى المياه في كتب النوازل، فبيع الماء وتأجيره وإقراضه، وكيفية تقسيم المياه المشتركة والقواعد المتبعة في ذلك، وحل المنازعات التي تحدث بسبب استخدام المياه، وغيرها من الأحكام مما جاء في كتب النوازل إنما يعطينا صورة لما لعبه الماء في حياة المجتمع. وترصد هذه الدراسة القضايا المتعلقة بالمياه في منطقة المغرب العربي والأندلس من خلال الفتاوى والنوازل الفقهية في نوازل البرزلي المعروف بــ : جامع مسائل الأحكام لما نزل من القضايا بالمفتين والحكام . Abstract: The Maliki Nawazili jurisprudence considers a rich source of fatwa and ijtihad, as it monitors the developments of events and issues in society, Nawazil books, gives an idea of the development of water legislation in Islamic jurisprudence This is what we see in the fatwas of water in the Nawazil books, like selling, renting and lending water, how to divide common water, and resolving disputes that occur because of the use of water, and other rulings . This study monitors the issues related to water and know the methods of dealing with water resources and water provisions in the Arab Maghreb and Andalusia region through fatwas and Nawazil in “Ahkam El burzali” , to clarify for us some aspects of water provisions in terms of its economic importance And social and in terms of its ownership and the actions it responds to, and disputes that arise in connection with the use of shared waters.
