حماية المرأة من العنف الجنسي أثناء النزاعات المسلحة

Résumé: تهدف هذه الورقة البحثية إلى دراسة واقع النساء أثناء النزاعات المسلحة، وما يتعرضن له من انتهاك صارخ لحقوقهن وامتهان لكرامتهن بشكل مطّرد، حيث ترتكب ضدهن أعمال عنف واسعة النطاق، وتغتصب الآلاف من النساء والفتيات في إطار استيراتيجية ممنهجة، لذا فقد سعى المجتمع الدولي إلى حمايتهنّ وتجريم العنف الجنسي، وذلك من خلال اتفاقيات جنيف لعام 1949 وبروتوكوليها الإضافيين اللذين نصا صراحة على حظر كل أشكال العنف الجنسي ضد المرأة بما في ذلك الاغتصاب والإكراه على الدعارة ، كما أنشأ مجلس الأمن محاكم جنائية دولية لمحاكمة مجرمي الحرب، حيث كيفت هذه الأفعال على أنّها جرائم حرب وجرائم ضد الإنسانية، فضلا عن ذلك فإنّ الفقه الإسلامي كفل لهن الحماية اللازمة، وكان له قصب السبق في تحريم العنف الجنسي وعده جريمة نكراء منذ أربعة عشر قرنا من الزمن. This research paper aims to study the reality of women during armed conflicts and the flagran violation of their rights and steadily degrading their dignity, as large-scale acts of violence are committed against them, and thousands of women and girls are raped within the framework of a systematic strategy, Therefore, the international community has sought to protect them and criminalize sexual violence, through the Geneva Conventions of 1949 and their Additional Protocols, which explicitly provide for: Prohibition of all forms of sexual violence against women, including rape and forced prostitution, The Security Council also established international criminal courts to try war criminals, where these acts were classified as war crimes and crimes against humanity. Moreover, Islamic jurisprudence guaranteed them the necessary protection, and took precedence in prohibiting sexual violence and considering it a heinous crime fourteen centuries ago.
