Résumé: الملخص: يهدف هذا البحث بشكل عام إلى إظهار أثر التكييف الفقهي في الحكم على القضايا المرتبطة بالمعاملات المالية المعاصرة، وإزاحة الستار عن ماهيته، والكشف عن مقوماته ومتطلباته. وهو ينطلق من عدّة تساؤلات، ويحاول الجواب عنها وفق تسلسل منطقي ومترابط، من خلال المباحث التفصيلية، وصولا في الختام إلى عرض موجز لأهم النتائج. Abstract: This research aims in general to show the effect of jurisprudential adaptation in ruling on issues related to contemporary financial transactions, unveiling its essence, and revealing its components and requirements. It stems from several questions, and attempts to answer them according to a logical and coherent sequence, through detailed investigations, and finally, a brief presentation of the most important results.
