التنظيم القانوني لعقد العمل بشرط التجربة

Résumé: تتناول هذه الدراسة التنظيم القانوني لعقد العمل بشرط التجربة والذي جاء نتيجةً للطبيعة القانونية التي يختص بها عن عقد العمل البات. وعلى الرغم من أنَّ المنظّــــم السعودي قد أحاط فترة التجربة بجملة من الشروط والقيود التي تضمن حُسن تطبيقه بعيداً عن إساءة الاستعمال أو التحايل؛ إلّا أننا نجد أن ضمانات حماية العامل من تعسُّف صاحب العمل عند إنهاء فترة التجربة لا تكفل تحقيق التوازن بين الحق المشروع لصاحب العمل بأن يتعاقد مع من تثبت لديه صلاحيته وكفاءته للعمل، وبين حق العامل في ألّا يُفسخ هذا العقد إلّا لأسباب ترجع إلى عدم صلاحيته أو عدم كفاءته، لذلك؛ فقد جاءت هذه الدراسة بهدف معالجة مسألة عدم وجود الحماية النظامية التي تشترط استظهار أسباب إنهاء صاحب العمل لعقد العمل أثناء فترة التجربة، وقد توصَّلت الدراسة لعدّة نتائج، أهمّها: أنَّ القيود التي أوردها المنظم على تمديد فترة التجربة وجواز تكرارها أسهمت في حماية العامل من إساءة استعمال وتحايل أصحاب العمل عند تطبيقهم لتلك الصلاحيات. This study examines the legal regulation of employment contracts with a probationary period clause. Although Saudi regulations have taken into account the probation period with a set of conditions to ensure its fair application, we find some remarks worth mentioning. The safeguards that protect the worker from employer abuse upon termination of the probation period might not ensure a balance between both parties. The legitimate right of the employer to contract with someone proven to be qualified for the job, and the right of the worker not to have the contract terminated except for reasons related to their competence. Then we address issue of the absence of regulatory protection requiring employers to provide reasons for terminating employment contracts during the probation period. It concluded that the restrictions imposed by the regulator on extending the probation period and allowing its repetition contributed to protecting the worker from abuse by employers when exercising these powers.
