دور الآليات الإدارية غير المتخصصة بالجزائر في حماية الملكية الفكرية

Résumé: ملخص: يعد امتلاك حقوق الملكية الفكرية مؤشرا على درجة تطور التكنولوجيا في بلد ما ومحفزا لحركة الاختراع والإبداع خاصة مع انتشار الوعي دوليا ووطنيا بضرورة التصدي لأي انتهاك لها، حيث تمتد اثار خطورة التقليد لهذه الحقوق على جميع المستويات بداية بأصحاب الحقوق كأول المتضررين، مرورا بالمستهلك وعلاقته بنوعية المنتوج، وانتهاء باقتصاد الدولة برمته. وبهدف تحقيق حماية أكثر فعالية لهذه الحقوق، لم تكتف معظم التشريعات المقارنة على غرار المشرع الجزائري بالحماية الإدارية لحقوق الملكية الفكرية استنادا إلى الهيئات الإدارية المتخصصة فقط، والمتمثلة في الديوان الوطني لحقوق المؤلف والمعهد الوطني للملكية الصناعية، بل وضعت هذه التشريعات كذلك أجهزة إدارية غير متخصصة لحمايتها، وتأتي في مقدمتها إدارة الجمارك وإدارة التجارة، نظرا لارتباط اختصاصاتهما ارتباطا وثيقا بحماية هذه الحقوق، من منطلق أن ممارستهما لاختصاصاتهما سوف تؤدي بالضرورة إلى حماية حقوق الملكية الفكرية، فما مدى فعالية الآليات الإدارية الغير المتخصصة في حماية حقوق الملكية الصناعية في الجزائر؟ Abstract: The possession of intellectual property rights is an indicator of the degree of development of technology in a country and a catalyst for the movement of invention and creativity, especially with the spread of awareness internationally and nationally of the need to address any violation of them, where the dangers of imitation of these rights extend at all levels, from rights holders as the first affected, through the consumer and its relation to the quality of the product, to the economy of the entire state. In order to achieve more effective protection of these rights, most comparative legislation, like the Algerian legislature, has not only protected the administrative protection of intellectual property rights solely on the basis of specialized administrative bodies, namely the National Copyright Office and the National Institute of Industrial Property, Management not specialized in the protection of industrial property rights in Algeria?
