Résumé: إن الجزاء المترتب على قيام المسؤولية المدنية عن الأضرار البيئية هو التعويض الممنوح للمتضرر،الذي يتم تقديره من قبل القاضي ويكون إما تعويض عيني أو نقدي بحسب طبيعة الضرر البيئي،إلا أن هذا الأخير يمتاز بنوع من الخصوصية التي جعلت قواعد المسؤولية المدنية غير كافية لمواجهة مثل هذه الأضرار البيئية لهذا سبب تما تبني نظام التعويض الجماعي للأضرار البيئية والذي يكمن في نظام تأمين المسؤولية عن أخطار البيئية وصناديق التعويض عن الأضرار التلوث البيئي . The penalty for civil liability for environmental damage is the compensation awarded to the victim, which is assessed by the judge and is either in-kind or monetary compensation depending on the nature of the environmental damage, but the latter is characterized by the type of privacy that made the rules of civil liability insufficient to cope with such Environmental damage This is why the system of collective compensation for environmental damage has been adopted.
