تسوية المنازعات المتعلقة بالاستثمار بين القضاء والتحكيم قراءة في ظل القانون 16-09 المتعلق بترقية الاستثمار

Résumé: لقد حافظ المشرع الجزائري في القانون 16-09 المتعلق بالاستثمار على الاختصاص الأصيل للقضاء الجزائري للنظر في المنازعات المتعلقة بالاستثمار، إلا أنه في المقابل ضمن للمستثمر الأجنبي تسوية النزاعات التي قد تنشأ بسبب استثماره عن طريق التحكيم. وعلى الرغم من أن هذا الأخير يعتبر طريقا بديلا عن القضاء النظامي إلاّ أن الواقع في حقيقة الأمر يثبت عكس ذلك. فالاختصاص الأصيل أضحى حبيس النص والطريق البديل أصبح مقترنا بالاستثمار الأجنبي وهذا رغم أن المشرع الجزائري جعل التحكيم نتيجة لاتفاق التحكيم الذي يجسده تراضي الأطراف، إلاّ أن التحكيم في منازعات الاستثمار أخذ في السنوات الأخيرة اتجاها مغايرا وذلك بتراض منفصل وبتحكيم إلزامي... Abstract The Algerian legislator has preserved in the law 16-09 on the promotion of the investment the recourse to the state jurisdiction as initial competence to settle the disputes. On the other hand, the foreign investor has a legal guarantee of his investment by arbitration, even if it is only an alternative way to the national justice, but the reality is different: the initial jurisdiction has become a prisoner of the text and the alternative route has become associated with foreign investment; thus the legislature has made arbitration the result of the arbitration agreement concluded by consent of the parties; lately, investment arbitration has taken a different direction, with separate consent and compulsory arbitration ...
