Résumé: تتعلق الدراسة بمعالجة قانونية حول النظام القانوني لتأسيس المؤسسات البنكية في التشريع الجزائري، حيث أقر المشرع الجزائري منظمومة قانونية خاصة بنظام البنوك وذلك من الإستقلال إلى غاية يومنا هذا، إذ عمد على إدخال إصلاحات تتوافق والتطورات الساسية والإقتصادية التي عرفتها الجزائر . تبعا لذلك، وبمقتضى الأمر رقم 03-11 المؤرخ في 26 أوت 2003 المتعلق بالنقد والقرض، المغدل والمتمم بموجب الأمر رقم 10-04 المؤرخ في 26 أوت 2010 و القانون رقم 17-10 المؤرخ في 11 أكتوبر 2017، وكذا النظام رقم 06-02 المؤرخ في 24 سبتمبر 2006 الصادر عن مجلس النقد والقرض، حدد المشرع الجزائري القواعد القانونية لتأسيس البنوك والمؤسسات المالية لممارسة النشاط المصرفي في الجزائر، حيث أخضعها لوجوب الحصول على الترخيص والإعتماد. تأسيسا لما سبق، فإن الدراسة تتمحور حول القواعد القانونية الخاصة بالحصول على الترخيص كإجراء أولي والإعتماد كإجراء ثاني لتأسيس. The study relates to a legal treatment about the legal system for the establishment of banking institutions in the Algerian legislation, where the Algerian legislator approved a legal system for the banking system from independence to this day, as he deliberately introduced reforms that correspond to the political and economic developments that Algeria has known. Accordingly, and pursuant to Ordinance No. 03-11 of August 26, 2003 relating to money and credit, amended and supplemented by Ordinance No. 10-04 of August 26, 2010 and Law No. 17-10 of October 11, 2017, as well as Regulation No. 06-02 of September 24, 2006 Issued by the Monetary and Loan Council, the Algerian legislator defined the legal rules for establishing banks and financial institutions to practice banking activity in Algeria, subjecting them to the obligation to obtain a license and accreditation. Based on the above, the study revolves around the legal rules for obtaining a license as a primary procedure and accreditation as a second procedure for incorporation.
