Résumé: الملخص إن من أهم ما استعان به علماء العصر لبيان أحكام المسائل الطبية المستجدة ، علم القواعد الفقهية ، ومن المسائل الطبية التي كثرت التساؤلات حولها، مسألة اختيار جنس الجنين، وتأتي هذه الدراسة لتسلط الضوء على أثر قاعدة الحاجة تنزل منزلة الضرورة في الحكم على هذه المسألة، وذلك بعد دراسة طرق اختيار جنس الجنين ، و موقف الفقهاء و القانون من هذه المسألة، ومن أهم ما تم التوصل إليه من نتائج: أنه لا يجور اختيار جنس الجنين بسبب الرغبة في جنس معين أو بسبب مرض وراثي إلا في حالة أن يكون المرض الوراثي يصيب جنسا معينا، وكان خطره واضحا جليا، وغيرها من النتائج المهمة، ضمّنتها الخاتمة مع التوصيات. Abstract : The affair of choosing the gender of fetus is a medical issue with a lot of questions surrounding it, and this study will shine light upon the effect of the comprehensive maxim "the needs take place of the necessities" upon its ruling, after looking at it from all angles such as jurisprudence and legally And from the most important conclusions reached is: that it is not permissible to select the gender of the fetus except in the case that the it was necessary and urgent to choose the gender of the fetus due to a hereditary disease, and other such conclusions included in the closing chapter along with recommendations and advice.
