تنزيل الحاجة منزلة الضرورة - القروض الربوية في فقه الأقليات نموذجا -

Résumé: تندرج هذه الرسالة في دراسة إحدى أهم القواعد الفقهية وهي تنزيل الحاجة منزلة الضرورة. المتفرعة عن القاعدة االكبرى المشقة تجلب التيسير ؛ حيث بينت مفهوم القاعدة ،ثم بينت مكانتها عند الفقهاء. ودليلها الشرعي من الكتاب والسنة كما أبرزت في هذه الدراسة أن الحاجة يمكن ان تكون في حكم الضرورة في استباحة المحظور وتكون حكما دائما عاما. كما قمت بتطبيق هذه القاعدة على مسألة فقهية معاصرة وهي حكم القروض الربوية في فقه الأقليات المسلمة.وذكرت ما أفتى به الفقهاء والمجامع الفقهية في المسألة ـ وهو المنع ، لأن التعامل بالربا مجمع علي تحرميه في كل الشرائع السماوية المنزلة. "Resume This dissertation deals with one of the most important issue in jurisprudence which is making the need in the same status as necessity. This issue is taken from the principle the toughness can be removed by facilitation. I explained the previous principle which means permitting things that meant to be forbidden. Then I moved on to show its importance within scholars and what Quran and Sunnah have proven about it. Moreover, in this study, I pointed out that the needy may be in the same necessity status in the expropriation of the prohibited and be a permanent provision covering the needy and others if they are general and if it is specific like permitting the forbidden things temporarily to the needy by taking into account the specific status and the conditions of such the necessity. This is what the jurists and the jurisprudential councils have done to reduce this rule to riba-based loans in the jurisprudence of Muslim minorities in the countries of the West.
