فعالية الالتزام بالضمان في عقود الاستهلاك

Résumé: ملخص: يعتبر الحق في الضمان من أهم الحقوق الأساسية التي نظمها المشرع بموجب القانون 09-03 المتعلق بحماية المستهلك كما يعدّ من أهم الالتزامات التي تقع على عاتق البائع. ويُعبّر هذا الالتزام عن رغبة المشرع في أن يكون اقتناء المشتري للأشياء موضوع العقد يستجيب للغرض الذي أعدّ له. غير أن الواقع العملي يثبت أن هذا الحق حال دون تفعيله وتجسيده واقعيا. Abstract: The right to guarantee is considered one of the most fundamental rights that the legislator has organized under article 09-03 related to consumer protection and the suppression of fraud, and it is also one of the most important obligations of the seller, this commitment expresses the legislator’s desire that the buyer’s acquisition of objects mentioned in the contract meet the wait of consumer. However, reality proves that the right to guarantee is still remains inactive and unrealizable.
