Résumé: باللغة العربية: جاء القانون رقم 09-03 المتعلق بحماية المستهلك وقمع الغش والنص التطبيقي له المرسوم التنفيذي رقم 21- 244 المؤرخ في 31 ماي 2021 المحدد لكيفيات و شروط تقديم خدمات ما بعد البيع ملزما المنتج والمستورد كمتدخل في عملية عرض المنتوج للاستهلاك؛ بالتزامين هامّين هما الالتزام بالضمان وكامتداد له الالتزام بتقديم الخدمة ما بعد، وهوما نظمه المشرّع في إطار ضمان قانوني بقوة القانون وضمان اتفاقي خاضع لمبدأ العقد شريعة المتعاقدين، لذلك الإشكالية التي يطرحها الموضوع تتمثل أساسا في: ماهي أحكام التزام كل من المنتج والمستورد بالخدمة ما بعد البيع في إطار الضمان القانوني والضمان الاتفاقي؟ Abstract : Law No. 09-03 related to consumer protection and the suppression of fraud, and Decree No. 21-244, obligates the producer and the importer as interfering in the process of presenting the product for consumption; With two obligations, the commitment to the guarantee and obligation to provide after-sales service, which was organized by the legislator within the framework of a legal guarantee by the force of law and agreement guarantee, the law of the contracting parties, and accordingly the problem is represented in: What are the provisions of the commitment of each of the producer and the importer to the service after the sale within the framework of the legal guarantee And the warranty agreement?
