القانون الواجب التطبيق على الحضانة في علاقات الزواج المختلط

Résumé: يشكل موضوع الحماية المقررة للطفل في آثار انحلال الزواج المختلط من حيث إسناد الحضانة أو إسقاطها إحدى المواضيع الشائكة في مجال القانون الدولي الخاص، نظرا لاختلاف التشريعات المقارنة في تحديد المختص ونظام الحماية المقررة للطفل، لذلك نجد أن التشريعات المقارنة تسعى إلى تسهيل مهمة القاضي في هذه المسألة من خلال إقرار نص خاص يحدد القانون الواجب التطبيق على الحضانة لمواجهة هكذا وضعيات قانونية، سواء تعلق الأمر بإسناد الحضانة أو إسقاطها من إيجاد القانون الأنسب لحماية مصالح الطفل المحضون ووفقا لما تقتضيه روح قواعد تنازع القوانين في موضوع الحضانة، هذا الأمر كان غائبا في قواعد التنازع الجزائري مما يثير إشكالات في تحديد القانون المختص The subject of the protection of the child in matters of attribution or abandonment of custody in the effects of the dissolution of a mixed marriage is one of the thorny subjects in the field of private international law, given the difference of comparative legislation in the definition of the applicable law and of the protection system set up for the child, for this purpose we therefore note that the compared laws seek to facilitate the task of the judge in the matter by fixing by the legislator a text special law that defines the law applicable to custody to deal with such legal situations, whether related to the award or abandonment of custody to find the most appropriate law to protect the interests of the child and in accordance with the spirit of the conflict of law rules on custody, this question was absent from the Algerian conflict rules, which poses problems in determining the competent law in the matter
