إشكالية تنازع القوانين في الحضانة (دراسة مقارنة) Conflict Of Laws In Custody (a Comparative Study)

Résumé: ملخص: تعتبر الحضانة من آثار انحلال الزواج، وهي من المسائل المهمة في رعاية الطفل وتحقيق حمايته، وتثير هذه المسألة إشكالات عديدة في مجال تنازع القوانين في التشريع الجزائري والمقارن، نتيجة لاختلاف التشريعات حول القانون الواجب التطبيق، في هذا الإطار سعت مختلف الدول إلى وضع قواعد لحل مشكلة تنازع القوانين في الحضانة، إلا أن هذا لا يعني إيجاد حل لكل التعقيدات التي يثيرها موضوع الحضانة في القانون الدولي الخاص، سواء ما يرتبط بتطبيق ضابط الجنسية أو الإشكالات الناتجة عن إسناد الحضانة في الزواج المختلط. ولمعالجة هذه الإشكالات حاول كل من الفقه والتشريع والقضاء إيجاد حلول تتماشى مع مبدأ المصلحة الفضلى للمحضون. Abstract: Custody (hadana) is one of the effects of the marriage dissolution, it’s an important issue for child protection, this subject raises many problems in the field of conflict of laws in Arab and Algerian legislation due to the difference in legislation on the applicable law. Therefore, countries have sought to establish rules to solve the problem of conflict of laws in custody, but that does not mean solving all the issues raised by custody in the conflict of laws. In order to respond to these problems, jurisprudence, legislation and the judiciary have sought solutions in accordance with the principle of protection of the interests of the child subject to custody.
