فلسفة المشرع الجزائري في الحد من العقاب في ظل السياسة الجنائية المعاصرة

Résumé: الملخص: من خلال هذه الدراسة نسعى إلى بيان توجه المشرع الجزائري نحو تبني فلسفة الحد من العقاب مسايرا بذلك تطور السياسة العقابية، باستبدال العقوبات السالبة للحرية خصوصا الحبس قصير المدة، بعقوبات أو بدائل أخرى أكثر تأثيرا ونفعا للمجرم. حيث تساعد هذه البدائل في عملية الإدماج الاجتماعي للمجرم المحكوم عليه، وتحقق الغرض المنشود من العقاب وهو إصلاح المجرم وتأهله. Abstract : In this study, we seek to demonstrate the tendency of the Algerian legislator to adopt a philosophy of reducing punishment, in line with the development of punitive policy, by substituting penalties for deprivation of liberty, especially short term imprisonment, with more effective penalties or alternatives for the offender. These alternatives help in the process of social integration of the convicted offender and achieve the desired purpose of reforming and qualifying the offender.
