الغرامة الجزائية كبديل للحبس قصير المدة في قانون العقوبات الجزائري

Résumé: الملخص للعقوبة السالبة للحرية أثرها الملموس في مكافحة الجريمة، وتبدو مزاياها أكثر وضوحا حين تكون طويلة المدة حيث تحقق أهدافها من ردع وإصلاح وتأهيل للمحكوم عليهم. ورغم هذه المزايا للعقوبات السالبة للحرية فإنها لم تسلم من العيوب والانتقادات، و خاصة العقوبات السالبة للحرية قصيرة المدة التي يترتب عنها أضرار كثيرة، لذلك تعتبر عقوبة الحبس قصير المدة ضررها أكبر من نفعها. وكان من نتيجة هذه المساوئ والاضرار الناشئة عن تطبيق العقوبة السالبة للحرية قصيرة المدة ضرورة التفكر في بدائل لهذه العقوبة أقل سلبية وأكثر جدوى من حيث تحقيق أغراض العقاب. وأخذت هذه البدائل اهتماما كبيرا من الدراسة من خلال المؤتمرات والدراسات والبحوث والتشريعات، ومهما حاولنا البحث عن البدائل لعقوبة الحبس قصير المدة فتبقى الغرامة تتبوأ الصدارة من بين هذه البدائل نظرا لأهميتها الاقتصادية والتقليل من ازدحام السجون وعدم تعريض المحكوم عليهم إلى الاختلاط بغيرهم من محترفي الإجرام. الكلمات المفتاحية: الغرامة ; بدائل الحبس ; قصير المدة ; مساوئ الحبس; الحد من العقاب. Abstract Freedom-depriving punishment has a tangible effect in combating crime, its advantages become more evident when it is of long duration, as it achieves its objectives of deterring, reforming and rehabilitating the convicts, Despite these advantages of freedom-depriving punishments, it has not been spared from flaws and criticism, especially the short-term freedom-depriving punishments that result in many harms, so a short-term prison sentence does more harm than good. As a result of these disadvantages and damages arising from the application of the punishment that deprives freedom of a short period of time, it was necessary to think about alternatives to this punishment that are less negative and more feasible in terms of achieving the purposes of punishment, these alternatives received great attention from the study through conferences, studies, research and legislation, and no matter how hard we try to find alternatives to punishment Imprisonment is short-term, so the fine remains the first among these alternatives due to its economic importance, reducing prison overcrowding, and not exposing convicts to mixing with other criminal professionals.
