الحماية القانونية للبيئة بين قواعد القانون الدولي وانتهاكات الدول

Résumé: الملخص: سعت قواعد القانون الدولي إلى جعل البيئة محل حماية دولية، فأبرمت العديد من الاتفاقيات والمواثيق الدولية التي تجسد هذه الحماية زمني السلم والحرب. إلا أن هذه الحماية ولو أنها تميزت من ظاهرها الشكلي بزخم النصوص القانونية، فهي بالمقابل لا تزال قاصرة من حيث فعاليتها بدليل الانتهاكات الدولية التي أضحت تطال البيئة يوما بعد يوم ، الأمر الذي أوجب اتخاذ العديد من الرهانات التي تحقق التوافق بين النص القانوني و مبدأ الحماية الفعلية في إطار قواعد القانون الدولي. Abstract The rules of international law sought the environment as a subject of international protection, which is why numerous international conventions .and pacts were concluded to enshrine this protection in times of peace and war However, even if this protection has been distinguished from its formal appearance by the dynamics of legal texts, its still remains deficient in terms of effectiveness as evidenced by the international violations which begin day after day, which has necessitated making numerous challenges to achieve compatibility between the legal text and the principle of effective protection within the frame work of the rules of . international law
