الجهود الدولية للحد من التعسف في استعمال الشارة الدولية

Résumé: هناك صورتان رئيسيتان لاستخدام الشارة؛"تفعيل الحماية واستخدام الدلالة والشارة هي أولاً، علامة واضحة تجسد الحماية التي يمنحها القانون الـدولي للطواقم الطبية والمعدات والمباني التابـعة للقوات المسلـحة أثناء النزاعات المسـلحة.وتمتـد هذه الحماية لتشمل المنظمات الإنسانية التي تعمل بالقرب من الوحدات العسـكرية من أجل تخفيف معاناة الجرحى والأسرى والمدنيين الذين يقعـون في مناطق النـزاعات المسلحة. ويشار إلى هذا الإستخدام في العادة بعبارة "استخدام الحمـاية"وفي كثير من الحالات التي تشهدها السـاحة الدولية يساء إستخدام الشارة المميزة،حيث لا تتحقق معه الغـاية المنشودة من تأمين الحمـاية لحاملي الشـارة المميزة أو حتى للمواقع والأشياء التي توضع عليهـا هذه الشـارة،إلا أن ذلك لا يعـني الوقوف موقف سلبي أمـام هذه التجاوزات،إذ يجـب اتخاذ التدابير والإجراءات اللازمة للحيلولة دون وقوعـها،بل وحتى قمـع هذه الخروقات بعد وقوعـها،وهو ما أشارت إليه العديد من الاتـفاقيات الدولية والتـشريعات الوطنية.
