ماهية الجرائم البيئية في نطاق القانون الدولي الجنائي

Résumé: الملخص: نرمي من وراء هذه الورقة البحثية إلى استعراض الجوانب الفقهية والقانونية المتعلقة بماهية الجريمة البيئية الدولية، ذلك أن مشكلة التلوث البيئي في زمن النزاعات المسلحة تشكل أحد أهم القضايا والمشكلات التي تواجه المجتمع الدولي ككل، مما فرض على المجموعة الدولية التوجه نحو توحيد جهودها والتنسيق فيما بينها بقصد البحث عن أفضل السبل لمواجهة هذه المشكلة والتي تنطوي على مخاطر كثيرة تهدد البشرية. وهي الجهود التي أدت إلى بروز فرع جديد من فروع القانون الدولي يتمثل في القانون الدولي الجنائي لحماية البيئة يقر في أغلب مبادئه وأحكامه جملة من الأساليب الردعية التي تستهدف التقليل والحد من الآثار السلبية للجريمة البيئية الدولية كونها جريمة من جرائم حرب. الكلمات المفتاحية: البيئة، الجريمة الدولية، جريمة حرب، الجريمة البيئية العالمية. lAbstract: By this research sheet, we aim to present the doctrinal and legal aspects related to the essence of international environmental crime, this, since the problem of environmental pollution in times of armed conflict represents one of the most important cases. and problems with which the international society as a whole is confronted, which has forced the international community to move towards the unification of its efforts and inter coordination in order to seek the best ways to counter this problem which involves many dangers threatening humanity. And it is these efforts that have allowed the emergence of a new section of international law, international criminal law for the protection of the environment which enshrines in most of its principles and clauses a set of dissuasive means aimed at minimizing and to end the negative effects of international environmental crime considered a war crime.
