تأثير القضاء الدستوري على عمل البرلمان-بين موجبات الحماية وحدود الرقابة- دراسة على ضوء القضاء والفقه الدستوري المقارن

Résumé: الملخص: تحقيق دولة القانون هي أهم أهداف القضاء الدستوري، من خلال مراقبة إخضاع السلطة التشريعية لأحكام الدستور، وعدم انتهاكها للحقوق والحريات التي يكفلها الدستور للأفراد، وإلا سقطت السلطة التشريعية في دائرة عدم الدستورية، إذا تحركت ضدها دعوى دستورية، بهدف إرجاعها إلى جادة الصواب. تبرير أهمية القضاء الدستوري من باب حماية المبدأ الديمقراطي تكمن في عملية تصحيح علاقة القضاء الدستوري بالمبدأ الديمقراطي وحماية البرلمان في عمومه ومن ثمة التأكيد على حماية هذا المبدأ، الأمر الذي يعد من أهم دوافع نجاح القضاء الدستوري. وتأكيدا على هذه الحماية يلتزم الأمر وجوب تقيد البرلمان بعدد من القيود والضوابط التي تكفل ممارسة الرقابة الدستورية في إطارها القانوني الصحيح. Abstract: Achieving the rule of law is the most important goal of the constitutional judiciary, controlling the submission of the legislative authority to the provisions of the Constitution and not violating the rights and freedoms assigned by the Constitution to individuals, otherwise the legislative authority falls into the circle of unconstitutionality, if a constitutional trial moves against it, with the aim of putting it back on the right track. To justify the importance of the constitutional judiciary in terms of protecting the democratic principle, it is necessary to correct the relationship between the constitutional judiciary and the democratic principle and protect the parliament in general, and then emphasize the protection of this principle, which is one of the most important reasons for the success of the constitutional judiciary. In order to assert this protection, Parliament must comply with a number of restrictions and controls to ensure that constitutional review is exercised within the framework legal framework specific to it.
