قواعد الاختصاص والحكم في إشكاليات التنفيذ الموضوعية Rules Of Competence And Judgment In Substantive Implementation Problems

Résumé: الملخص: لما كان الأصل أن تسير إجراءات تنفيذ الحكم بسهولة ويسر باعتبار أن مرحلة التنفيذ هي المرحلة الأخيرة من مراحل التقاضي، إلا انه قد يحصل أن تثار منازعة أو إشكاليات متعلقة بالتنفيذ كإشكاليات موضوعية يطلب من خلالها إصدار حكم موضوعي يحسم النزاع في أصل الحق المتنازع عليه سواء استندت المنازعة إلى أسباب إجرائية أو موضوعية . وتبين لنا بعد البحث والتحليل أن الإشكاليات الموضوعية التي تعترض التنفيذ والتي لم تحظ بتنظيم مستقل في قانون التنفيذ الأردني يطبق عليها ما يطبق على باقي الإشكاليات كالوقتية من حيث إجراءات رفعها والجهة المختصة، ومن ثم الحكم بها وإخضاعها للقواعد العامة في بعض المسائل والإجراءات باعتبار أنها دعوى (منازعة) موضوعية القصد منها فصل النزاع وحسم موضوعه . وقد انتهت الدراسة إلى عدم كفاية التنظيم القانوني بخصوص المنازعات الموضوعية ونتمنى على المشرع الأردني معالجة هذه الإشكاليات بشكل مستقل بنصوص تنفرد بها وتحديدها ووضع ضوابط قانونية تحكمها. Abstract As the original procedure for the execution of the judgment is easy and easy as the execution stage is the last stage of litigation, it may occur that a dispute or problems related to implementation may arise as substantive problems in which a substantive judgment is required to settle the dispute in the origin of the disputed right, whether the dispute is based. It was found after the research and analysis that the substantive problems facing the implementation, which did not have an independent regulation in the Jordanian implementation law applied to what is applied to the rest of the problems such as the temporal in terms of procedures and the competent authority, and then judged and subjected to the general rules in some matters and procedures as a case ( Objective) intended to separate the dispute and resolve the issue. The study concluded that there is insufficient legal regulation regarding the substantive disputes. We hope that the Jordanian legislator will address these problems independently by means of texts that are unique to them and identify them and establish legal rules governing them
