منازعات التنفيذ الموضوعية في المواد المدنية بين الفقه والقانون

Résumé: ملخص : مرحلة التنفيذ هي التي يتجسد من خلالها منطوق السند التنفيذي الحائز لقوة الشيء المقضي فيه بالتطبيق الفعلي على أرض الواقع، لكن قد تكون هناك أسباب وعوائق تعترض عملية التنفيذ يمكن إزالتها وتسمى إشكالات تنفيذ وقتية، إلا أنه في بعض الأحيان قد يستحيل مواصلة التنفيذ إلا بعد زوالها من خلال البت فيها من قبل المحكمة المختصة وذلك إما بتعديل منطوق السند التنفيذي أو إلغاءه أو تأجيله، فيكون لتدخل القضاء دور مهم في ضمان شرعية التنفيذ الصحيح وهذا ما يطلق عليه منازعات التنفيذ الموضوعية.
