المتابعة الجزائية لجرائم الفساد -دراسة مقارنة بين القانون الفلسطيني والجزائري

Résumé: ملخص الاطروحة اننا بصدد دراسة احد اخطر الجرائم "جرائم الفساد" قام المشرع الفلسطيني والمشرع الجزائري بأنشاء قانون خاص لمكافحة الفساد، واقر بموجبها مجموعة من القواعد الإجرائية الخاصة لمتابعة مرتكبي جرائم الفساد، ذلك من خلال استحداث أساليب تحري خاصة تتمثل هذه الأساليب في أسلوب التسرب والاختراق واعتراض المراسلات وتسجيل الأصوات والتقاط الصور،بالإضافة الىذلك وسعصلاحيات الضبطية القضائية، ووسع الاختصاص المحلي والنوعي لقاضي التحقيق بالنسبة للتشريع الجزائري،وأضاف كل من التشريع الفلسطيني والجزائري جملة من القواعد التي تضمن فعالية التحقيق في جرائم الفساد كالتحفظ على الأموال والممتلكات التي يكون مصدرها غير مشروع، وانشاءه لسلطة قضائية متخصصة بالنظر في جرائم الفساد والمتمثلة في الأقطاب الجزائية المتخصصة بالنسبة للمشرع الجزائري ومحكمة جرائم الفساد في التشريع الفلسطيني، كما تضمن قانون الوقاية من الفساد ومكافحته الجزائري مجموعة من القواعد التي تضمن استرداد العائدات المتحصل عليها من جرائم الفساد والتي تشمل تدابير الاسترداد المباشر للممتلكات وتدابير استرداد الممتلكات عن طريق التعاون الدولي. الكلمات المفتاحية:"جرائم الفساد،البحث والتحري،اساليب التحري الخاصة،هيئة مكافحة الفساد،اجراءات التحقيق،اجراءات المحاكمة،تسليم المجرمين، العائدات الإجرامية". The abstract because we are studying one of the most serious crimes, "corruption crimes," Algerian and Palestinian legislators enacted a special law to combat corruption, as well as a set of procedural rules for tracking down the perpetrators of corruption crimes through the development of special investigation methods. noises and photographing. Moreover, it expanded the powers of the judicial police, and expanded the local and qualitative jurisdiction of the investigating judge in relation to the Algerian legislation, and both the Palestinian and Algerian legislation added a number of rules that guarantee the effectiveness of the investigation of corruption crimes, such as the seizure of funds and property whose source is illegal, and the establishment of a specialized judicial authority to look into Corruption crimes represented in the specialized penal poles for the Algerian legislator and the Corruption Crimes Court in the Palestinian legislation. The Algerian Anti-Corruption Law also included a set of rules that guarantee the recovery of proceeds obtained from corruption crimes, which include direct recovery measures for property and measures to recover property through international cooperation.
