التحكيم في العقود الإدارية الخاصة بنظام البوت B.o.t

Résumé: "يتناول هذا البحث و يهتم بدارسة التحكيم في مجال العقود الإدارية ذات الطابع الدولي و بالأخص عقود البوت B.O.T التي تمثل أحد أشكال المرافق العامة التي تلجأ إليها الدولة بمساهمة القطاع الخاص سواء كان الشخص محلي أو أجنبي و ذلك من أجل تخفيف الأعباء المالية التي تتحملها ميزانيتها و تحقيق إدارة سليمة لمشاريعها. وعقود البوت من العقود الدولية الاستثمارية التي تتميز بطول مدتها ما يؤدي إلي ظهور منازعات بشأنها مما يستوجب على الأطراف العقد المتنازعة اللجوء إلي التحكيم كآلية و وسيلة فعالة في إنهاء الخلافات التعاقدية بعيدا عن مرفق القضاء. فالإشكالية المطروحة في هذه الدراسة تتمحور حول: هل أن المشرع وضع قواعد قانونية كفيلة بتطبيق آلية التحكيم لفض نزاع الناجمة عن عقد البوت. ودراستنا هذه تسعى جاهدة من خلال تسليط الضوء على هذا الموضوع و إبراز لأهمية التحكيم في تسوية المنازعات التي تنشأ أو ستنشأ في هذا النوع من العقود. ""This study deals with the study of arbitration in the field of administrative contracts of an international character, in particular BOT (Build–operate–transfer) contracts, which represents one of the forms of public utilities used by the State with the contribution of the private sector, whether a local or foreign, in order to alleviate the financial burdens borne by the budget and achieve sound management of their projects. And contracts of pot of international investment contracts, which are characterized by a length of time leading to the emergence of disputes on them, which requires the parties to the dispute contract resort to arbitration as a mechanism and an effective way to terminate contractual disputes away from the Judicial Facility. The question raised in this study is: Does the legislator establish legal rules that can apply the arbitration mechanism to resolve a dispute arising from the BOT contract? Our study strives to highlight this issue and to highlight the importance of arbitration in the settlement of disputes arising or arising in this type of contract. "
