التحكيم في عقود البوت

Résumé: الملخص: يعد القضاء الوسيلة الأساسية لحل النزاعات ، لكن مع تطور ظروف التجارة والإستثمار و عصرنة المرافق العامة، نشأت إلى جانبه وسائل أخرى لحسم المنازعات، وبذلك ظهر التحكيم كطريق بديل لحل المنازعات. تهدف هذه الدراسة إلى معالجة نظام التحكيم في عقود البوت B.O.T (عقد البناء والتسيير ونقل الملكية) باعتباره نموذج مستحدث لعقود الامتياز التقليدية من اجل تسيير وإنشاء وترقية المرافق العامة، مع إخضاعه لمجموعة من الشروط والضمانات القانونية التي تمنح للدولة حق مراقبة التنفيذ في جميع مراحله. Abstract :The judiciary is the main means of settling disputes, but with the development of trade and investment conditions and the modernization of public services, other means of settling disputes have appeared in parallel, and thus arbitration is emerged as alternative means of resolving disputes. This study aims to address the arbitration system in B.O.T contracts (Construction ,Management and Transfer of Ownership Contract) as an updated model of traditional concession contracts for the management, establishment and modernization of public services, subject to a set of legal conditions and guarantees that grant the State the right to monitor implementation at all stages
